Trinity Telecom may rely on the Fair Use Policy where your:
a) usage of Trinity Telecom Data Services;
b) usage of Trinity Telecom Mobile Fleet Plan. |

Excessive Use |
| 1.3.1 |
In the case of Trinity Telecom GPRS services, downloading and/or uploading of more than 1GB of data
each month on or from Your Mobile Phone is excessive use |
| 1.3.2 |
In the case of the Mobile Fleet plan office add-on, free calls between Business User Group (Group)
mobiles and back to Group landlines, usage in excess of a total of 100 minutes of calls from (Group
mobiles to Group landlines, or Group Mobile to Group mobile) per connection per month, averaged across
your Trinity Telecom Mobile Office account is excessive use, or where these calls represent more than
70% of the total call minutes of the mobile bill |

Unreasonable Use |
| 1.4.1 |
It is unreasonable use of Trinity Telecom Data Services where Your use of Trinity Telecom Data Services
is reasonably considered by Trinity Telecom to be fraudulent or to adversely affect the Trinity Telecom
Network or other Trinity Telecom customers' use of or access to a Trinity Telecom Service or the Trinity
Telecom Network |

It is unreasonable use where your use of the Mobile Office add-on is reasonably considered by Trinity
Telecom to be fraudulent or to adversely affect the Trinity Telecom network or other Trinity Telecom
customers use of or access to the Trinity Telecom service or Trinity Telecom network |
| 1.4.3 |
Among other things, "fraudulent use" includes re-supplying a Trinity Telecom Service without Trinity
Telecom's consent so that someone else may access or use Trinity Telecom Data Services or take
advantage of fleet call prices or special pricing to an individual network |

Our Rights |

Where You are in breach of this Fair Use Policy, Trinity Telecom may contact You to discuss changing
Your usage so that it conforms to this Fair Use Policy |
| 1.5.2 |
If, after Trinity Telecom has contacted you, Your excessive or unreasonable use continues, Trinity
Telecom may, without further notice to you: |

a) charge You a rate of 0.20c per KB for continued Data Services usage;
b) suspend or limit the service (or any feature of it) for any period We think is reasonably necessary;
and/or
c) terminate Your agreement in accordance with the standard form of agreement or the business terms
and conditions.
d) With regard to the Trinity Telecom Fleet Mobile with the back to Group landlines feature, where this plan
has been excessively or misused, in accordance with point 4 of this fair use policy, Trinity Telecom may
charge a timed rate of 12c per 30 seconds. Where there is misuse or excessive use this charge will be
back dated, and invoice to Trinity Telecom will be due and payable in the normal trading terms, this invoice
will still be due and payable even in the event of termination of agreement with Trinity Telecom. |
